Supremes Approve Stops and Searches Based on Anonymous Tips

Police car

Justice Antonin Scalia disagrees with the majority on the Court, “So long as the caller identifies where the car is, anonymous claims of a single instance of possibly careless or reckless driving, called in to 911, will support a traffic stop. This is not my concept.” Here’s the the Fourth Amendment standard for triggering a search: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
